Terms and Conditions

In contributing to The Dairy Council's www.smilefordairy.com, you agree to grant us a royalty-free, non-exclusive licence to publish and otherwise use the material in any way that we want, and in any media. You still own the copyright to everything you contribute to www.smilefordairy.com. This means you're free to take what you have produced and publish it somewhere else.

If your photo is accepted, we'll endeavour to publish your name alongside it on www.smilefordairy.com if you've provided it and unless you specify you don't want it published. The Dairy Council cannot guarantee that all photos will be published. Inappropriate and offensive material will not be published.

If you send us a photo by email, we will not use your email address for spam or direct marketing and we will not sell it or distribute it to any third parties. The only use we may make of your email address is if we need to contact you about your photo.

Children and Young People Policy

If you're submitting a photo of a child or young person please note that we're following the NSPCC's guidance on using photos of children. This means that if you send a photo of children or young people to www.smilefordairy.com or smile@smilefordairy.com:

  1. Your photo must not show their full names or other identifiable information such as the addresses of schools or clubs.
  2. Your photo must be appropriate.
  3. Children and young people should be suitably dressed. Do not send a photo of children that are dressed inappropriately as we will not publish it.
  4. By submitting a photo of children or young people, you agree that you have permission to do so and are granting us permission to use it in accordance with the information on this site and the terms and conditions set out here.
  5. By submitting a photo of children or young people, you agree that the children or young people are aware of the photo and its intended use and that you have their consent to do so.
  6. Protecting the safety of children and young people is of the utmost importance to The Dairy Council and we will not publish inappropriate material. Any photos or other materials sent to us which indicate harm or abuse of children will be reported to the police.

Permissions and indemnity

Where you are invited to submit any contribution to www.smilefordairy.com or smile@smilefordairy.com (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant The Dairy Council a perpetual, royalty-free, non-exclusive, sub-licenseable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play and make available to the public. If you do not want to grant to The Dairy Council the rights set out above, please do not submit your contribution to www.smilefordairy.com or smile@smilefordairy.com.

By submitting your contribution to The Dairy Council via www.smilefordairy.com or smile@smilefordairy.com, you warrant that your contribution:

  • is your own original work and that you have the right to make it available to the The Dairy Council for all the purposes specified above
  • is not defamatory
  • does not infringe any law

By submitting your contribution to The Dairy Council you indemnify The Dairy Council against all legal fees, damages and other expenses that may be incurred by The Dairy Council as a result of your breach of the above warranty.
